4. Course Accreditation, Qualifications and Scope of Practice
4.1 Current Status: Non-Accredited Educational Courses

All courses currently offered by Artistic Touch – Nail Training Academy are NON-ACCREDITED educational masterclasses. These are professional development courses designed to enhance your skills, knowledge, and techniques in nail care.
What This Means:
- Courses provide valuable education and skill development
- Certificates of completion are provided upon finishing courses
- Certificates demonstrate your commitment to learning and professional development
- Certificates are NOT formal qualifications recognized by regulatory bodies
- Courses do NOT lead to government-recognized certifications (e.g., NVQ, SVQ, or equivalent)
Non-Accredited Certificates
Non-accredited certificates are issued for completion only and are not professional qualifications. They cannot be used to obtain insurance or represent accredited status. These courses are designed solely for independent skill enhancement, artistic improvement, and professional technique refinement, and must not be represented as equivalent to accredited qualifications.
4.2 Certificate of Completion vs. Accredited Qualification
Certificate of Completion (What We Currently Provide):
- Proof you have completed the course material
- Demonstrates professional development
- Shows commitment to education
- Can be included in your portfolio
- May be recognized by some employers or clients
- Does NOT carry regulatory weight
Accredited Qualification (Not Currently Offered):
- Recognized by official awarding bodies (e.g., VTCT, ABT, City & Guilds)
- May be required for certain insurance policies
- Often required for licensing in regulated markets
- Includes external assessment and verification
- Meets specific industry standards
4.3 Use of Certificates and Marketing
You MAY:
- Display your certificate of completion in your workspace
- Include it in your professional portfolio
- List completed courses on your CV or resume
- Mention courses in your professional biography
- Reference skills learned in client communications
You MUST NOT:
- Claim to hold a formal qualification or accreditation you do not possess
- Misrepresent our certificates as government-recognized qualifications
- Use misleading terms such as “certified nail technician” unless you hold formal accreditation
- Falsely claim regulatory approval or official recognition
- Imply our courses meet licensing requirements they do not meet
4.4 Insurance and Licensing Implications

Our current courses may NOT satisfy:
- Professional liability insurance requirements
- Local authority licensing conditions
- Salon employer qualification requirements
- Certain client expectations for “certified” practitioners
Your Responsibility:
- Check your insurance provider’s requirements before relying on our certificate
- Verify local licensing requirements in your area
- Confirm whether employers require accredited qualifications
- Be transparent with clients about your training background
4.5 Future Accredited Course Offering
We are actively working toward offering accredited certification courses in the future. When available:

- Separate terms and pricing will apply

- Different refund and cancellation policies may apply

4.6 Scope of Practice and Legal Responsibility
Important Legal Notice:
Completing our courses does NOT:
- Grant you a license to practice (if your region requires one)
- Authorize you to perform regulated procedures
- Provide legal protection or professional indemnity
- Replace the need for appropriate insurance coverage
- Exempt you from local health and safety regulations
You are solely responsible for:

4.7 Verification and Authenticity
Certificate Verification:
- All certificates include a unique certificate number
- Employers or clients may verify authenticity by contacting us through our contact form
- We maintain records of all issued certificates
- Fraudulent certificates or misrepresentation will be reported
We will verify:
- Whether a certificate was genuinely issued by us
- The course name and completion date
- The student name on the certificate
We will NOT disclose:
- Course grades or performance details (without your consent)
- Payment information
- Other personal information protected under GDPR
4.8 Verification of Prior Qualifications
For certain advanced courses, conversion training, or specialist masterclasses, students may be required to provide evidence of an existing accredited qualification or relevant professional experience before enrolment or certification.
Purpose of Verification:
This prerequisite requirement ensures:
- Compliance with ABT and industry safety standards
- Confirmation that the student holds an appropriate foundation of knowledge
- Protection of both the student and future clients from unsafe or unqualified practice
- Maintenance of professional training standards
Acceptable Evidence:
Students may be asked to provide one or more of the following:
- A valid accredited qualification certificate or diploma (e.g., ABT, VTCT, CIBTAC, or equivalent)
- Proof of current professional insurance covering relevant techniques
- Written documentation demonstrating equivalent industry experience or previous education
- Portfolio evidence of professional work (for experience-based verification)
Verification Timeline:
- Evidence must be submitted before enrolment for courses with mandatory prerequisites
- For optional verification courses, evidence may be required before final certification
- We will notify you of specific requirements at the time of course selection or purchase
Confidentiality and Data Protection:
All submitted qualification evidence will be:
- Treated as strictly confidential
- Handled securely in accordance with UK GDPR
- Stored as outlined in our Privacy Policy
- Retained for up to 7 years to meet legal, accreditation, and insurance record-keeping obligations
- Securely deleted after the retention period, unless longer retention is required by law
Consequences of Non-Compliance:
Students who are unable or unwilling to provide acceptable proof of qualification when required may experience:
- Delayed course access — enrolment may be paused until evidence is received
- Delayed certification — final certificate issuance may be withheld
- Enrolment cancellation — if suitable evidence cannot be provided, your enrolment may be cancelled (refund eligibility subject to our Refund Policy)
Important: This verification requirement may also apply to selected non-accredited masterclasses where advanced product knowledge, prior practical experience, or safety compliance is essential for participant and client safety.
Exemptions and Appeals:
If you believe you meet the prerequisite requirements but do not have formal documentation, you may:

- Provide a detailed professional portfolio or experience summary
- Request a pre-enrolment consultation to determine eligibility
All verification decisions are made at the sole discretion of Artistic Touch Studio Ltd and are final.
5. Marketing Badges – Terms of Use
Upon successful completion of certain courses, you will receive digital marketing badges that you may use to promote your services and demonstrate your training.
5.1 What You Receive

Available Badge Types:

5.2 Permitted Uses
You MAY use badges to:
- Display on your professional website or portfolio
- Include in social media profiles and posts (Instagram, Facebook, TikTok, etc.)
- Add to business cards, brochures, and marketing materials
- Show in your physical workspace (printed or digital display)
- Include in email signatures
- Use in online booking systems or service menus
5.3 Usage Requirements
When using badges, you MUST:
- Use the badge exactly as provided (no modifications to design, colors, or text)
- Maintain aspect ratio (do not stretch or distort)
- Ensure the badge is clearly visible and legible
- Use badges only for courses you have personally completed
- Include the badge as part of truthful marketing materials
- Comply with advertising standards and regulations in your jurisdiction
5.4 Prohibited Alterations
You MUST NOT:
- Change the colors, fonts, or design elements
- Add additional text or graphics to the badge
- Crop, rotate, or distort the badge
- Combine the badge with competitor branding
- Use the badge in a way that implies endorsement of other products/services
- Modify the badge to misrepresent your level of training
5.5 Prohibited Contexts
You MUST NOT use badges:
- To imply official accreditation or regulatory approval (unless applicable)
- In connection with illegal services or activities
- To promote products or services we do not endorse
- In a manner that damages our reputation
- After your usage rights have been terminated
- To suggest partnership, sponsorship, or official affiliation beyond student status
5.6 Revocation of Rights
We reserve the right to revoke your badge usage rights if:
- You violate these Terms of Use
- You misuse the badge or our brand
- You engage in unprofessional conduct that reflects poorly on Artistic Touch
- You make false claims about your training or qualifications
- You use the badge in connection with illegal activities
- Your course enrollment is terminated
Upon revocation:
- You must immediately cease all use of badges
- Remove badges from all platforms (website, social media, printed materials)
- Failure to comply may result in legal action for trademark infringement
5.7 Ownership and Intellectual Property

- All badges remain the intellectual property of Artistic Touch Studio Ltd
- You receive a limited, non-exclusive, non-transferable license to use the badge
- You do NOT own the badge design or trademark
- You may not sell, transfer, or sublicense badge usage rights
- This license is personal to you and cannot be passed to others

When using badges, you acknowledge that:
- “Artistic Touch” is a registered trading name of Artistic Touch Studio Ltd
- All associated logos, names, and branding are protected intellectual property

We encourage you to:

6. User Account and Registration
6.1 Account Creation
To access our courses and services, you must create a user account. By creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
6.2 Required Information
Mandatory Registration Details:
- Full legal name (as it should appear on your certificate)
- Valid email address (for account access and communications)
- Country of residence (for legal and tax compliance)
- Password (meeting our security requirements)
Optional Information:
- Phone number (for course support)
- Business name (if purchasing as a professional)
- Social media handles (for community features)
- Professional background (to personalize your experience)
6.3 Account Security
Your Responsibilities:
- Create a strong, unique password
- Never share your login credentials with anyone
- Log out from shared or public devices
- Enable two-factor authentication if available
- Report suspicious activity immediately
We will NEVER:
- Ask you for your password via email or phone
- Request your payment details outside our secure checkout
- Contact you via unofficial channels requesting sensitive information
6.4 Account Termination by You
You may close your account at any time by:

- Following account closure procedures in your account settings
Upon closure:
- You lose access to all purchased courses (no refund unless within cancellation period)

- You provide false information
- You use our services for illegal purposes
- Your account shows signs of security compromise
Upon termination by us:

- You must cease use of all certificates and badges
- Outstanding amounts remain payable
- We may pursue legal action for damages
6.6 Account Inactivity
If your account remains inactive for 24 consecutive months:

- We may archive your account
- Your data will be retained according to our Privacy Policy
- You can reactivate by logging in or contacting us
6.7 Name Changes
If you need to change the name on your account or certificate:

- Name changes are permitted for legal reasons (marriage, deed poll, etc.)
- Changes for other reasons are at our discretion
- We may charge an administrative fee for certificate reissue
6.8 Account Transfer
Accounts and course access are NON-TRANSFERABLE.
- You cannot sell, gift, or transfer your account to another person
- You cannot transfer course access to another individual
- Attempting to do so violates these Terms and will result in termination
6.9 Multiple Accounts
You may only maintain ONE active account per individual. Creating multiple accounts for the purpose of:
- Evading bans or restrictions
- Abusing promotions or discounts
- Circumventing access limitations is prohibited and will result in termination of all accounts.
7. Governing Law and Jurisdiction
7.1 Governing Law
These Terms and Conditions, and any dispute arising from or relating to them, shall be governed by and construed in accordance with the laws of Scotland and the United Kingdom, without regard to conflict of law principles.
7.2 Exclusive Jurisdiction
You agree that any legal action or proceeding relating to these Terms or your use of our services shall be brought exclusively in the Sheriff Court of Tayside, Central and Fife at Dundee, and you irrevocably submit to the exclusive jurisdiction of that court.
7.3 Waiver of Other Jurisdictions
By accepting these Terms, you waive any right to bring legal proceedings in any other court or jurisdiction, whether in Scotland, elsewhere in the UK, or internationally.
